As I mentioned in my response to James, if clients need to ask for tombstones, then this problem disappears.
As you hinted at above, the opt-in for clients has an added benefit even for clients that DO understand tombstones. On the initial sync of a feed, most sync-aware clients will still want to ask for the feed without tombstones, so that they can just get the non-deleted items. After the initial sync, then they can ask for tombstoned items as well.
