I don't think so.

The XML Infoset spec mentions a case where "there will be no XML document 
corresponding to the information set."[1]  That case is a cosmetic one, but it 
does establish an unfortunate independence. 

I think this is an infelicity in the infoset spec: it needs to have some equivalent notion
to well-formed. Otherwise people will blithely use "XML infoset" on the
understanding it is some subset of "XML document".
